Terms of service.

The service

Witness analyzes images and videos to estimate whether they are AI-generated or manipulated. The service includes face-swap detection, generator attribution (estimating which AI tool produced the content), detection heatmap visualizations (showing which image regions influenced the verdict), and local scan history. Results are probabilistic estimates, not definitive determinations. It is provided by A Labs Inc.

Results are not guarantees

Detection technology has inherent limitations. Witness verdicts:

  • May produce false positives (real content flagged as synthetic) and false negatives (synthetic content missed)
  • Should not be the sole basis for legal, financial, employment, or safety decisions
  • Are not admissible expert testimony or forensic certification
  • Detection heatmaps are visual explanations of model behavior, not pixel-level proof of manipulation
  • Generator attribution is a best-effort estimate and may not correctly identify the tool or model used
  • Face-swap detection accuracy varies with image quality, lighting, and the sophistication of the swap technique

You are responsible for how you interpret and act on results.

Acceptable use

You agree not to:

  • Upload content you lack rights to analyze
  • Upload illegal content, including CSAM (reported to authorities)
  • Use Witness to harass, stalk, or defame individuals
  • Attempt to reverse-engineer detection models, detection heatmaps, generator attribution logic, or face-swap detection to build evasion tools
  • Resell or redistribute the service without agreement

Rate limits

Witness enforces rate limits to keep the service available for everyone. If you exceed the limit, requests will be temporarily rejected. Repeatedly attempting to circumvent rate limits may result in your device identifier being blocked.

Subscriptions and payments

When applicable, Pro subscriptions renew automatically until cancelled. Cancellation takes effect at the end of the billing period, and you retain access to paid features until that period expires. We do not offer partial refunds for unused portions of a billing period. Refunds are handled per platform policy (Apple App Store / Stripe). We reserve the right to modify subscription pricing upon 30 days' prior notice. Price changes take effect at the beginning of the next billing period following the notice.

Account termination

We may suspend or terminate your access to Witness at any time if we believe you have violated these terms or if your continued use poses a risk to the service or other users. You may delete your account at any time by contacting legal@witness.vision. Upon termination, your right to use Witness ceases immediately, but your obligations under the Disclaimer, Indemnification, and Governing law sections survive.

Scan history

Witness stores your recent scan history (verdicts, scores, timestamps, and thumbnail previews) in your browser's localStorage. This data is stored entirely on your device and is never transmitted to our servers. You can clear your scan history at any time from the Witness interface or by clearing your browser data. We are not responsible for scan history data lost due to browser data clearing, device changes, or browser updates.

Intellectual property

You retain rights to media you upload. You grant A Labs Inc. a limited license to process it (and retain it, subject to the Privacy Policy) for providing and improving the service. The Witness software, models (including detection models, detection visualization logic, face-swap detection pipeline, and generator attribution classifiers), and branding remain the property of A Labs Inc.

Disclaimer and limitation of liability

Important

The service is provided “as is” without warranties of any kind, express or implied, including warranties of accuracy, fitness for a particular purpose, or non-infringement. Detection heatmaps, generator attribution, face-swap analysis, and all other outputs are informational only and do not constitute forensic certification, legal evidence, or expert testimony. To the maximum extent permitted by law, A Labs Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including damages arising from false positives, false negatives, reliance on detection results, or decisions made based on information provided by Witness. A Labs Inc.'s total aggregate liability is limited to the amount you paid in the prior 12 months, or fifty dollars ($50), whichever is greater.

Indemnification

You agree to indemnify and hold harmless A Labs Inc. and its officers, employees, and agents from any claims, damages, or expenses arising from your use of Witness, your violation of these terms, any decision you make based on Witness results, or any content you share or distribute that includes Witness outputs (such as detection heatmaps or forensic reports).

Governing law

These terms are governed by the laws of the State of Delaware, USA.

Changes to these terms

These terms may be updated. The current version will always be available at this URL with an updated date. Continued use of Witness after changes constitutes acceptance.
